Deciding who created a digital work can be a complicated process.
In the case of a song, the lyrics may have been written by one person, but the music played and sung by another person. The songwriter would be the creator of the lyrics, but the artist who sung the lyrics is considered the creator of their performance. If you are selling the song, the artist would be the creator. If you are selling the lyrics, the writer would be the creator.
Below is a list describing a digital work media type and general recommendations of who should be listed as the creator for the media type.
- Song
- A song is usually performed by a single artist or band who would be considered the creator of the performance.
- Spoken Audio
- The creator of spoken audio is usually the speaker themselves. For instance, the comedian giving a stand-up routine would be considered the creator.
- Album
- An album is generally a collection of songs by a single artist. In this case, the artist would be considered the creator. However, in an album of multiple artists, it is possible that the creator would be considered the album's publisher.
- Video Clip
- Since video clips are usually made by a single person, the person who shot the video is usually considered the creator. For instance, Tony would be considered the creator of Tony's Vaction Video.
- Video Episode
- Video episodes are usually a single work in a series of related videos, like a TV show. The creator would probably be the director or the producer of the episode.
- Movie
- The creator of a movie is the director. Although many people are responsible for making the movie but the director is usually considered to have been the creator.
- Music Video
- The creator of the music video would probably be considered the artist or artists who performed in the video. It is also possible that the music video director could be considered the creator.
